Let's NOT Build More

How did crime and violence become 'the norm' in HUD, DHCD, and MassHousing financed multifamily housing complexes? 

September 2008, The Patriot Ledger reported some of the crime and violence in Rockland, Massachusetts with an accurate description of a multifamily apartment complex.  This wasn't the first and isn't the last incident of crime and violence on this 'newly renovated' subsidized property.  Some 'nonresidents' live with residents while management conveniently looks the other way.  And where are those promised security cameras?  Here is an excerpt from the published news story describing Rockland Place dba Spring Gate Apartments.

.....reported this year at the Spring Gate apartment complex, formerly known as Rockland Place, he said.

The 35-year-old housing development is home to 204 rental apartments, including 193 apartments for low-income tenants. For more than a decade, it has been a hot spot for crime in Rockland, including rapes, beatings, shootings and knife attacks.

On Aug. 26, two police officers were nearly struck by rocks at a back-to-school event at the Spring Gate apartment complex. In July, two residents were charged with beating another man with rocks.

It’s an apartment complex, and any time you have an apartment complex with a lot of people squeezed into a tight geographic area, you’re going to have problems,” Lt. Barry Ashton said.

Lt. Barry Ashton's comment offers little hope to good residents in this type of subsidized housing. It offers no solution or honest intention to deter crime at Spring Gate.  His apathetic attitude toward crime in Rockland Place and/or Spring Gate Apartments reflects that of corporate management, owners, and government officials. 

When laws and regulations aren't enforced, subsidized apartment complexes like Rockland Place dba Spring Gate harbor crime and imprison the innocent.  These mismanaged multifamily properties are allowed to become a neighborhood nuisance.  Corporate landlords may continue to benefit from running nuisance properties, but nearby homeowners suffer when their private property decreases in value.

Supplying more government grants and tax monies to non-compliant landlords is wasteful and does not provide safe, decent, affordable housing.  'Affordable Housing Certificates', issued directly to law-abiding citizens, could be a better way for HUD to provide safe, decent, affordable housing to the needy. These issued certificates could also provide the freedom to choose a respectable place of residence with more control and accountability.  If 'apartment complexes with a lot of people squeezed into a tight geographic area cause problems', building and financing more subsidized apartment complexes like Rockland Place and Spring Gate should be discouraged.

Hingham District Court
A charge of malicious destruction of property worth more than $250 against Armando M. Oliveira, 19, of 212 Martha Drive, Rockland, was dismissed by Judge Mooney due to lack of prosecution. The offense was alleged to have occurred July 9 in Rockland.

Charges of assault and disturbing the peace against Nilton Rodriques, 31, of 110 Martha Drive, Rockland, were dismissed by Judge Patrick Hurley. The offenses were alleged to have occurred April 16 in Rockland.

Healthy Housing

The top section of the Affordable Health Care Act reads: To provide affordable, quality health care for all Americans and reduce the growth in health care spending, and for other purposes.... Click here if you'd like to read the 1990 pages of this Bill.

The 'and for other purposes' concerns me already, and I haven't even read the rest of the 1990 pages.  It may not matter to our elected officials, but like many American citizens, I don't like the idea of Government taking control of so many areas of everyone's lives.  Perhaps it's due to some of what I've already experienced and witnessed in their subsidized housing program.

If their Affordable Health Care program works anything like the government subsidized housing program at Rockland Place dba Spring Gate, I seriously hope it doesn't pass. Simply put, their housing program breeds corruption, disempowers residents, and victimizes people through non-compliance of laws and regulations.  In reviewing this Health Care Reform Bill, let's keep in mind our government and H.U.D. promise safe, decent, affordable housing too.

Accessible for Whom?

Life at Rockland Place dba SpringGate Apartments is more difficult than it has to be for several residents, especially for those with a disability or handicap.  This is due to leniency and non-compliance of rules and laws. Good luck to the handicapped in wheelchairs who need to gain access to 212 Martha Drive and other buildings in that area.  The wheelchair-bound are not entitled to access certain areas.

Sidewalk ramps are extremely limited throughout this tax-credited property.   If you're in a wheelchair, you'll likely be travelling in the street with traffic.  Openings to dumpsters are situated in awkward ways and gates are left open to dumpster areas, which also proves problematic for handicapped residents to dispose of trash.  Only handicapped units do NOT have screens available for the patio doors. While handicapped units have lit patios, most common areas remain dark.

Several handicapped residents haven't a handicapped parking space available, probably because there are more handicapped / disabled residents than there are handicapped parking spots.  Additionally, some handicapped parking signs have been knocked over and Management hasn't replaced them for two years. Most people who aren't even handicapped are allowed to park in handicapped areas. Signs are faded and difficult to read. Delivery people use those limited designated handicapped spaces; people who are "just running in and out" use them; and people with no handicap who recognize Management's apathy, also park in those spaces without consequence.

Property owners and Management deceptively promised all residents daily shuttles to stores and the commuter rail for doctor appointments, etc. Considering the unavailable parking and lack of public transportation, this promised accommodation certainly would have made life more liveable at this subsidized housing complex.

From promised security cameras to the falsification of official documents, deceptive business practices here are widespread. Promised security cameras don't exist because they could reveal several obscene and unfair housing practices including those involved with distributing drugs and filthy feminine pads in the swimming pool and inside mailboxes. Security cameras could also expose the public nudity in common areas, vandalisms, break-ins, violence, and could even reveal illegitimate residents not listed on lease agreements. 

MassHousing and Rockland Health Board fail to enforce State Sanitary Codes and other laws at Rockland Place dba SpringGate Apartments.  Corporate partners and Management of this subsidized property have proven themselves to be above-the-law.   The following violations inside SpringGate are obvious ones.....
105 CMR 410.000: MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION (STATE SANITARY CODE, CHAPTER II)

410.253: Light Fixtures Other than in Habitable Rooms or Kitchens
(A) The owner shall provide and so locate electric light switches and fixtures in good working order so that illumination may be provided for the safe and reasonable use of every laundry, pantry, foyer, hallway, stairway, closet, storage place, cellar, porch, exterior stairway and passageway. 
(B) The owner shall provide working incandescent light bulbs or fluorescent tubes in all required light fixtures in all common areas of any dwelling.
410.552: Screens for Doors
The owner shall provide a screen door for all doorways opening directly to the outside from any dwelling unit or rooming unit where the screen door will be permitted to slide to the side or open in an outward direction, provided, that in an owner-occupied unit, the owner need provide screens only for those doorways used for ventilation. All new or replacement screens in screen doors shall be of not less that 16 mesh per square inch.
Said screen door:
(1) Shall be equipped with a self-closing device except where the screen is designed to slide to the side; and
(2) shall be tight-fitting as to prevent the entrance of insects and rodents around the perimeter; and
410.553: Installation of Screens
The owner shall provide and install screens as required in 105 CMR 410.551 and 410.552 so that they shall be in place during the period between April first to October 30th, both inclusive, in each year.

Housing Fraud Continues

Housing fraud continues at the HUD subsidized Rockland Place dba SpringGate Apartment complex.   Though reported to authorities for several years, Management continues to allow several people to live in apartments without listing their names on occupancy agreements.  This common practice gives an inaccurate accounting of some household incomes and becomes costly to legitimate residents and taxpayers.

Nancy Pelosi's Weepy Concern for Violence

Several residents at the HUD subsidized Rockland Place Apartments have felt similar to Nancy Pelosi for many years while having to actually witness violence in courtyards!  It's troubling to read of HUD's phony anti-drug rhetoric.  It's troubling because it reminds me of the violent drug debates taking place inside the 204-unit subsidized housing complex.  There are still no promised security cameras.

HUD falsely claims they offer safe, decent, affordable housing.  Safe, decent housing is not where children wake up distraught and terrified from sounds of violent screams outside their windows.  I still recall the blood puddles, unconscious body, ambulance lights, temple stabbing incident, and hear the echoes of gut-wrenching screams from people hit by rocks, bats, beer bottles, and slashed with a sword in HUD subsidized drugged-up housing.

I wish our government truly cared where the hell they house low-income people and children. I wish enforcements and standards were higher in multifamily housing.  I wish housing developers and corporate landlords really had to comply with laws, regulations, and occupancy agreements while enriching themselves with taxpayer dollars through HUD.   Would someone please pass Ms. Pelosi a tissue?

Last I heard, Rockland Place Apts. along Martha Drive and Hannah Way receives taxpayer funds because it's a subsidized housing complex.  How many alleged criminals can any subsidized property owner rent to before it's considered deliberately creating a nuisance property?   How many repetitive business listings in the hotel, storage, and restaurant categories can you find inside your favorite HUD affordable housing complex before fraud is considered?

Smokescreens and Blindfolds, Oh My!

The current manager of Rockland Place had little difficulty blazing the path while serving as head-of-maintenance. Since promoted to property manager by Cornerstone Corp., and retaining that position under First Hartford Realty, her torch has been laid to rest and her spark extinguished.

Vandalism and other crime continues at the HUD subsidized Rockland Place Apartments dba Spring Gate in Rockland, Mass. with little or no consequences to perpetrators.  Why the leniency in compliance of laws and lease agreements?  Why are there still no promised security cameras installed in common areas, even after corporate owners received millions in grants and tax credits?

I just finished viewing some video about ACORN from the website: http://biggovernment.com/   It's definitely amazing video. It reminds me of  how our government provides funds for the corporate partners at Rockland Place Apts.  no matter how badly mismanaged.  Illegal acts continue to go unnoticed or minimized by management and other authorities.  Will those convenient blindfolds ever wear out?

Playing with Fire

Monday, August 24, 2009, around 10:45pm: Rockland firefighters quickly responded to another fire alarm at 100 Martha Drive, Rockland, MA.  Kids were loitering in the first floor hallway before the alarms sounded. According to the fire dept. it smelled like candles had been burning.  Property management was notified again. (See July's incident.)  
Some parents and management have not done enough to resolve this ongoing problem. Good fire prevention measures NOW, may save another Rockland Place child from becoming scorched.  Promised security cameras installed in common areas would deter some fire setting and other crime.  Hopefully, property owners will install them before they have to collect
on fire insurance policies again. This reminds me of one of the laws these Lessors violated: Chapter 186, Section 21.  (Several of our good photos showing fire setting and other violations have mysteriously vanished from this blog.)

HUD Plagued with Indecent Housing

The scandal-plagued government agency that oversees housing spends more than $12 million a year to illegally provide homes to thousands of lifetime registered sex offenders, many convicted of raping children.

Although Congress banned federally subsidized housing for serious sex offenders more than a decade ago, the Department of Housing and Urban Development (HUD) still gives the taxpayer-financed perk to about 3,000 serious sex offenders banned by federal law from receiving it.

CH-CH-CH CHANGE$

Effective August 1, 2009, Change 3 to HUD Handbook 4350.3 Rev. 1, makes numerous clarifications and changes regarding income, live-in aides, and pensions. It completely revises Chapter 9 (Billing and Special Claims) for property owners to comply with TRAC 202C requirements. Actually, I have to wonder why HUD bothers to change any rule or regulation when they lack enforcement. Perhaps President Obama will need to appoint a Czar to enforce HUD Regulations? (wink)

Spring Gate Specials

MONDAY, 7-27-09 from early afternoon through evening hours: Officials from Rockland Police, Sheriff's Dept., Bureau of Criminal Investigations (BCI), and State Police inside building 81 Hannah Way to investigate another crime on this subsidized property. Still, this corporate landlord has not kept promises to install security cameras for crime reduction.

12:00am: Police called for attempted break & enter at 91 Hannah Way. Locked bedroom window to first floor apartment pried opened from outside while resident inside.
9:45am: Police were called to 191B Martha Drive concerning a child, approximately 1-yr.-old, wandering alone in the common areas of Spring Gate Apts.
9:50am: Fire dept. and maintenance called due to a faulty smoke detector at 187D Martha Drive.

Repetitive Risks at renovated Rockland Place

Time is long overdue for Management to step up and take immediate and effective action regarding the ongoing safety concerns. When it comes to risking lives of residents, Rockland Place Apts. dba Spring Gate needs to do more than simply send repetitive warning letters.

Thursday, July 23, 2009, an alert and considerate resident notified the fire department and neighbors of gas fumes. When firefighters arrived, a bicycle stored in the hallway was in the way and a motorbike was discovered inside an apartment at 100 Martha Drive.

Repetitive hazards on this subsidized property include: firesetting, grills on patios, cluttered and obstructed hallways, darkened common areas, gas-powered equipment and motorbikes stored inside wooden-structured apartment buildings, etc. Spring Gate's property management is fantastic at obtaining rent increases; if only they could be as competent in enforcing rules and regulations.

Scams on Subsidized Property

Rockland Place Apartments dba Spring Gate is off of John A. Dunn Memorial Drive, behind the small Rockland Plaza. When you turn into this 204-unit subsidized housing complex, you are on Martha Drive. When you reach the corner, you can continue on Martha Drive by taking a right. If you take a left, you'll turn onto Hannah Way. These are the only 2 roads inside this housing complex. There is no thru-way. This is not business zoned; yet unexplainable business listings have appeared in print and online for years. I don't believe other taxpayers would favor subsidizing illegal businesses inside HUD subsidized housing. Do you?

Large Gaps in Oversight

When conducting annual inspections at Rockland Place Apartments dba Spring Gate in Rockland, Massachusetts Housing Finance Agency show gaps in their oversight again. At first, MassHousing claims Management was not in compliance, but then suddenly became compliant in time to receive another rent increase. Realistically though, putting all friendships and conflicts of interests aside, Management of Rockland Place is still non-compliant.

Negligent Security and Premises Liability

A person may have a claim against a landowner or property manager if they sustained an injury due to the failure of the landowner or property manager to protect the injured person from foreseeable crimes on or near the property. It is important to seek legal counsel qualified to handle the specific type of investigation needed to establish that the landowner or property manager knew, or should have known, that such an event was foreseeable. Victims can sustain injury from assault, battery, robbery, rape or any number of other crimes committed by individuals that exploit the insufficient security or lighting of the premises. Negligent security cases may be brought against hotels, shopping centers, malls, schools, housing complexes, office buildings or nightclubs. Most personal injury attorneys won't charge unless they win the case.

Premises Liability is a general term that includes claims for injuries or death resulting from dangerous conditions that existed or activities that happened at a particular location. For instance, premises liability cases can arise from a trip and fall, dangerous conditions that are not readily apparent on a sidewalk or in a pool; injuries caused by insufficient lighting, negligently designed stairways or handrails; or negligent security at a particular location. If corporate partnerships at Rockland Place were made to keep their promises to install security cameras in common areas and hallways, management could be better informed as to which children are playing with fire in their hallways, etc.! Maybe they don't want to know. Obviously, when wasting their government grants and monies, safety for residents is NOT one of their priorities.

Premises liability cases can be complicated because many different entities may own, lease, maintain or control the premises. Additionally, there can be different policies of insurance that may cover the incident. It is important to obtain legal advice and promptly investigate the claim and secure evidence early on because if the dangerous condition is fixed, you may forever lose the evidence that you need to prove your case. As a general rule, property owners are responsible for injuries which occur as a result of dangerous conditions on their property, which the owner knew about, or should have known about and failed to warn others about. Renting to drug-induced alcoholics who habitually party around darkened parking lots is just one example of deliberate negligence, especially when conditions aid and abet criminal activity on a nuisance subsidized property. It really is amazing what some corporate landlords get away with.

Quantity vs. Quality




President Obama’s FY 2010 budget contains proposals to preserve and increase the amount of affordable housing available. This budget increases the utilization of tax monies to fund poorly-run HUD programs such as Project-Based Rental Assistance where good tenants become silenced or victimized by unethical property managers over and over again. Should the tenant move to escape victimization, the Rental Assistance ends; it stays with the project. So who does this type of assistance really help?

Project-based rental assistance programs are more likely to benefit corporate partners who contribute to political campaigns. Because HUD and housing authorities are negligent in enforcing rules and regulations, too many multi-family housing complexes have a prison-like atmosphere. As it stands, tax dollars will continue to preserve crime and violence for more substandard subsidized housing.

Name Games - Conflicts of Interest

Name changes for organizations, partnerships, and corporations mislead consumers and the general public. A business name change does not correct patterns of unethical or illegal conduct. It can, however, protect abusive individuals in powerful positions. (See links of interests in left-hand column, below.)

For example, Rockland Place Apartments added a name change of Spring Gate. More partners were brought in and more government funds were had. Of course, this was all in the guise of helping low-income residents, who grew even more distressed with poorly planned, unnecessary, and shoddy renovations. This 204-unit HUD subsidized housing complex still has the same legal firm, deceptive business practices, property manager, maintenance, breaches, etc. as the previous name(s) used. So, what was really resolved here?

Some recent stories about Acorn, remind me of some of the deceptive business practices of Rockland Place dba Spring Gate.... (Or maybe I should say Cornerstone Corp. dba First Hartford Realty Corp.)? For crying aloud, it's like a mild case of PTSD dba ADHD!

After numerous fraud allegations, Acorn, or more formally, Association of Community Organizations for Reform Now, changed their name to Community Organizations International. Because of questionable business practices, their name may have been tarnished some. Other than a name change, will their methods of doing business remain?

Acorn and Rockland Place are not the same organization, but have much in common:
a. Many of the same individuals remain in powerful positions after business name changes.
b. Both receive government funds, including millions in grants from H.U.D.
c. Both are accused of illegal conduct.
d. Both are politically involved and connected.
e. Both are non-profit and claim to help those in poverty.
f. Both are accused of attempting to silence and intimidate critics.

Warning... Lug Nuts on the Loose!

June 18, 2009, an important notice was taped on entry doors in front of each building at Rockland Place/Spring Gate Apts., Rockland, Mass. .... "It has been brought to our attention that LUG NUTS have been missing off of vehicles in the Spring Gate parking lot. For your safety, please check your vehicle before driving. Sorry for any inconvenience. If anyone notices anything suspicious, please contact the office."

This notice would not be necessary if corporate landlords kept their promises to install security cameras on their subsidized, nuisance property. Residents can now feel warm and fuzzy inside knowing management is sorry for a possible life and death situation.

What began as an operating-under-the-influence arrest on Hannah Way spilled into a behind-the-scenes struggle at the Rockland police station.`On June 16, John Verrier, 19, of 45 Hannah Way, Rockland, was charged with operating a vehicle under the influence of alcohol and operating with a suspended license, a marked lanes violation, disorderly behavior, malicious damage of property (a watch) and speeding. The passengers, two teen girls from Pembroke and Whitman and one male, 20, of Rockland, were also taken into the Rockland police station under protective custody when police deemed them too drunk and disoriented to care for themselves. Another Spring Gate Special ...

Rockland man charged with Wal-Mart theft

ABINGTON - A Rockland man is accused of trying to steal $250 worth of goods from the Wal-Mart store on Brockton Avenue (Rte 123).
Ruben Gonzalez, 30, of 100 Martha Drive was arrested Saturday morning at the store. Gonzalez was charged with two counts of larceny over $250 and one count of threatening to commit murder. When a clerk tried to stop him as he was running out of the store, the man claimed to have a gun and said he would shoot the clerk if anyone tried to stop him, Police Chief David Majenski said. Gonzalez pleaded innocent on Monday in Brockton District Court. Bail was set at $500 and was posted. A pretrial hearing is set for June 23.

On Alert for Safe, Decent Housing

June 2 and 3, 2009 from 3-6 pm, a Rape Aggression Defense system program (R.A.D.) will be offered to resident children between the ages of 5-19 yrs. of age. This FREE course is being taught by the Police Chief's wife, Officer Sue Llewelyn in the Spring Gate Clubhouse at 52 Hannah Way, Rockland, conveniently located next door to a sex offender.

According to local papers dated January 23, 2009, 39-yr.-old Mr. Goucher, of 34 Hannah Way, Apt. F in Rockland was arrested for failing to register as a sex offender. He isn't the first offender to live inside this subsidized family housing complex.

STOUGHTON — A Rockland man is being held on $1,000 bail in the county jail after a Shaw’s supermarket employee caught him allegedly injecting heroin in the ladies restroom.
Melvin Cumba, 29, of 230 Martha’s Drive, Apt. C, Rockland Mass, was arraigned Friday in Stoughton District Court on charges of possession of heroin for a subsequent offense, trespassing and disorderly conduct. Judge Francis T. Crimmins ordered Cumba held on $1,000 bail at the Norfolk County House of Correction in Dedham pending a hearing June 16. ********
The Patriot Ledger posted May 15, 2009: A charge of malicious destruction of property worth more than $250 against Armando M. Oliveira, 19, of 212 Martha Drive, Rockland, was dismissed by Judge Mooney of Hingham District Court, due to lack of prosecution. The offense was alleged to have occurred July 9 in Rockland.
ALSO, Charges of assault and disturbing the peace against Nilton Rodriques, 31, of 110 Martha Drive, Rockland were dismissed by Judge Patrick Hurley of Hingham District Court. The offenses were alleged to have occurred April 16 in Rockland.
